Welcome to SafeVault! These Terms of Service (“Terms”) govern your use of the SafeVault mobile application (“App”) and any related services provided by SafeVault (“we,” “our,” or “us”). By using the App, you agree to be bound by these Terms, so please read them carefully.
1. Acceptance of Terms
By accessing or using the App, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
2. Description of the App
SafeVault is a mobile application designed to provide users with a secure platform to save, manage, and encrypt photos, videos, and contacts in a protected space known as the Safe Vault.
3. User Accounts
3.1. You may choose to create a user account with a passcode to access the App’s full functionalities, including saving photos, videos, and contacts in the Safe Vault.
3.2. While registration is not mandatory to use the App’s basic features, certain functions like the backup feature require email verification.
3.3. You are responsible for maintaining the confidentiality of your passcode and account credentials, and you agree not to share them with others.
3.4. You are solely responsible for all activities that occur under your account, whether or not authorized by you.
4. Privacy and Data Security
4.1. Your privacy is of utmost importance to us. Please review our Privacy Policy here, which explains how we collect, use, and safeguard your information.
4.2. All user data, including photos, videos, and contacts, are securely encrypted and stored within the App’s Safe Vault to ensure data protection.
4.3. If the user has enabled the backup feature, we will download the encrypted files and save them in a secure store. However, we will not access or view the content of the encrypted files.
5. User Content and Browser Usage
5.1. You may upload, save, or display photos, videos, and contacts within the App’s Safe Vault. You retain all rights to your User Content, and we will not access or view your encrypted data.
5.2. The in-app browser does not save personal data and is protected by the passcode for enhanced security.
6. Subscriptions and In-App Purchases
6.1. Subscription Plans
6.1.1. SafeVault offers subscription plans that provide access to additional features and functionalities within the App. These subscription plans are available with various durations, including weekly, monthly, yearly, or lifetime options.
6.1.2. The details of each subscription plan, including the features offered and pricing, are available within the App’s subscription section.
6.2. Free Trial
6.2.1. SafeVault may offer a free trial of the subscription plan to new users. The duration of the free trial period will be specified in the App.
6.2.2. At the end of the free trial period, your subscription will automatically convert to a paid subscription plan, and you will be charged accordingly, unless you cancel your subscription before the trial period expires.
6.3. Payment and Billing
6.3.1. Payment for subscription plans will be charged to your designated payment method through the App Store or Google Play Market, depending on your device and platform, at the start of the subscription period.
6.3.2. You agree to pay all fees associated with your subscription plan as they become due.
6.3.3. The subscription fee is non-refundable, except as required by applicable law or specified in our refund policy.
6.4. Automatic Renewal
6.4.1. Your subscription will automatically renew at the end of each subscription period unless you cancel automatic renewal through your account settings in the App Store or Google Play Market.
6.4.2. You can manage your subscription, including canceling automatic renewal, through your account settings within the App Store or Google Play Market.
6.5. Changes to Subscription Plans
6.5.1. SafeVault reserves the right to modify, update, or discontinue any subscription plan or pricing at any time without prior notice.
6.5.2. Any changes to your subscription plan or pricing will only take effect after the current subscription period ends.
6.6. Termination
6.6.1. You may cancel your subscription at any time. The cancellation will take effect at the end of the current subscription period.
6.6.2. SafeVault may terminate or suspend your subscription and access to the App at any time without prior notice for violation of these Terms or any other reason deemed appropriate by SafeVault.
6.7. Data Retention and Backup
6.7.1. Upon cancellation or termination of your subscription, you may lose access to certain features or data associated with your subscription plan, including the ability to restore photos and videos from the trash folder.
6.7.2. It is your responsibility to back up your data before canceling your subscription, as SafeVault is not responsible for the retention or backup of your data after subscription termination.
6.8. Refund Policy
6.8.1. SafeVault may offer refunds for subscription fees on a case-by-case basis, as required by applicable law or at the sole discretion of SafeVault.
7. Prohibited Conduct
While using the App, you agree not to:
7.1. Violate any applicable laws, regulations, or third-party rights.
7.2. Attempt to circumvent or compromise the App’s security measures.
7.3. Use the App for any unlawful, harmful, or fraudulent purpose.
8. Intellectual Property
8.1. The App and all its content, including but not limited to text, graphics, logos, images, and software, are the intellectual property of SafeVault or its licensors and protected by applicable copyright and other intellectual property laws.
8.2. You may not use, reproduce, modify, distribute, or display any part of the App without our prior written consent.
9. Disclaimer of Warranties
9.1. The App is provided on an “as-is” and “as available” basis without any warranties, express or implied.
9.2. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
9.3. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
10.1. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the App.
10.2. Our total liability to you for any claims related to the App shall not exceed the amount paid by you (if any) for using the App.
11. Modifications to the Terms
We reserve the right to modify these Terms at any time. If we make significant changes, we will notify you through the App or other means. Your continued use of the App after such modifications shall constitute your acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access to the App at any time for any reason without notice or liability.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.
